Bail forfeited after suspect missed SLO court date due to deportation

 

A Los Angeles-based bail bond company is out $100,000 after a suspected felon failed to make his date in SLO County court because he'd allegedly been deported.

 

Greg Jaquez Bail Bonds, a company based out of Hawthorn, lost its legal appeal surrounding the forfeiture of a $100,000 bond in the 2016 case of Darwin Alexis Mendoza. According to court records, the company argued that it was entitled to get the money back because Mendoza was detained and later deported by immigration officials after being released on bond.

 

In its briefs to the SLO County Superior Court, and later the appellate court, the company argued that it should get the money back because Mendoza was far from being "in the wind." He was an undocumented immigrant from Honduras who was in ICE custody and facing deportation. Under California law, companies can seek to have a bail bond forfeiture vacated if a defendant is temporarily or permanently made unable to appear in court because they are in the jurisdiction of another agency that won't extradite them.

 

According to the appeals court, while the company filed a motion asking the court to vacate the bond forfeiture within the appropriate 180-day period, they did not include sufficient evidence proving Mendoza was in ICE custody at the time or had been deported. According to the appeal court's written opinion, some evidence was eventually presented to indicate that Mendoza was in ICE custody under an alias, and that he'd been deported and banned from returning to the United States for 20 years.

UC Berkeley student arrested by border patrol

On Saturday, UC Berkeley student Luis Mora, 20, was detained by border patrol agents in Jamul, California at an internal checkpoint about 20 miles from the Mexican border. Mora came to the US from Colombia as a child and stayed after his visa expired. Like millions of other undocumented immigrants, Mora has lived under the constant threat of arbitrary detention and deportation.

 

Last weekend, Mora was driving back from a party with his girlfriend Jaleen Udarbe, 21, when they missed their turn and found themselves trapped by the checkpoint. In an interview with the San Diego Union-Tribune, Udarbe described Mora’s reaction when he realized he had to go through the checkpoint. “This is it for me,” he told her, “I’m sorry.”

SACRAMENTO, Calif. (AP) — California's top elections official says there are enough signatures to hold a recall election for Sen. Josh Newman.

 

Secretary of State Alex Padilla said Friday that nearly 70,000 signatures were determined to be valid.

 

Republicans looking to end a Democratic supermajority in the Senate have targeted Newman over his vote to increase gas taxes and vehicle registration fees.

 

The Fullerton Democrat narrowly won his race last year in a district that has historically elected Republicans.

I agree somewhat.Maybe that bail bonds guy should have checked into who he was posting bail for ? did the bail bondsman know this guy was an illegal ? it is wrong to keep his money,this state will take and keep money from anybody they can.

L.A. County officials confirm first case of sexually transmitted Zika virus

L.A. County officials said Thursday that a woman had been infected with the Zika virus by her partner in the first case of sexually transmitted Zika virus in the county.

 

A man who lives in L.A. County traveled to Mexico and became infected with the Zika virus in early November, and shortly afterward his female partner, who didn’t travel to Mexico, also developed the infection, officials said.

 

“This case is a reminder to take precautions during sex or avoid sex if you or your partner have traveled to an area with risk of Zika,” said Dr. Jeffrey Gunzenhauser, L.A. County’s interim health officer.

 

Zika virus, which has caused hundreds of babies to be born with birth defects in Brazil, is most commonly transmitted by mosquitoes. The virus can also be transmitted through sex, though that’s much rarer.

Yvette Felarca ordered to pay legal fees of former president of Berkeley College Republicans

 

An Alameda County Superior Court Commissioner ordered Yvette Felarca, the controversial Berkeley middle school teacher and activist, to pay $10,000 in attorney’s fees and $1,100 in court fees for her failed attempt to get a permanent restraining order against Troy Worden, the former head of the Berkeley College Republicans.

 

Commissioner Thomas Rasch issued the order Thursday before a scheduled hearing at the Hayward branch of the court. He said that Felarca’s legal actions were not brought in good faith. Felarca’s attorneys dispute that characterization and have said they intend to appeal the ruling.
