I need some help/advice

Ok september of last year i sold my 83 datsun pickup king cab. Well 4 months ago i got a photo radar ticket in the mail for the truck, i got severely pissed called dmv and sent in a photo, it was dropped. Well today i get a parking ticket in the mail, the guy has STILL not registered the truck in his name, its been almost a year. I dont know what to do, ive called the dmv again and they say the cant help. I called the ticket place and have pretty much been told im out of luck, either i pay it for him or I get sent to collections. What do you guys suggest?

 

Also i want to put the word out there for someone to watch for it for me, black spray paint witha tan interior plate number b74843l. This guy better hope i dont find him, he gave me a false number and a false address, If he hits anyone or dumps the vehicle anywhere im responsible for him being a dumbass.

 

Someone said i should report it stollen, all good for that if he didnt have the title, i dont feel like getting in trouble for a fradulant claim.

 

 

And i got to say this, my days of trusting people are OVER. For now on its straight to the dmv after i sell any vehicle. People just cant be trusted anymore.

In Washington it's simple... you fill out the release of interest online when you sell it.

You're supposed to get the buyer's driver's license number. Once that's filled out then that's evidence that you no longer own it, but if you don't fill it out you're liable for anything that happens until it is.

 

In WA, if a licensing goes to collections and isn't paid you can't renew you're driver's license.

Do they have any sort of way to register the car as a parts car rendering it unable to be re-tagged there?

 

Also if the title says your name dont matter if you have it or not, its whoevers name is on it and whos name is in the system.. least thats the way it is here.

My Family (the Buseys) ... sold a car back to the Toyota dealership last year....

 

 

2 weeks later we get 3 parking tickets in the mail........... call the police,,, explain that we already sent in a release of liability....... they say there is nothing they can do until the dealership releases all the information of the new buyer....

 

 

After 2 days on the phone with fuckin' Toyota......... we finally got the tickets to the "new" owner

I learned something when you sale a vehicle. Pull the tags off it. Those are your tags, not the new owners. This forces them to go to the DMV, or drive around without tags. In Texas I had to send a letter to the capital saying that I sold the truck, and gave what info about the new owner that I could in the letter. This info would show anytime that the tags were ran.

On newer titles I believe it's even on a perforated tear-off portion on the bottom for when you sell. That sucks man. I've had a similar situation happen with a lady who bought a car from me once. I got photo enforcement tickets in the mail, I got pissed sure, but I never paid one of them. Just set em aside in case I'd ever need them again. Never had a problem, no warrants for unpaid tickets, no reprocussions of any kind, things just kinda sorted themselves out after a while. I suppose if you wanted your vehicle back, you'd be the legal owner. Maybe that would teach this guy to not be such a flake and take care of business

^ Yah i actually did report it, i sent in the form on the title, and i did it online, yet it still doesnt matter unless he gets pulled over by a police officer. He can still keep it un-registered and rack up tickets on my expense which in my book is a broken system. I have enough bills i dont need to be paying out 40 bucks for this pos. Im going to start watching for the truck again, and if he gets one more ticket down there then i think ill be sitting down there a few days and wait for him to have a lil "talk" and escort him to the dmv, otherwise i will reposess the truck from his butt.

I keep the plates unless the buyer goes to DMV before taking possession of the vehicle. I know this doesn't help you now Dan, but for the future...

 

Definately get ahold of DMV and Sheriff's office to see what you can do. Local PD usually no help.

Yah if this was my old 81 i would of reported it stolen and loved to get her back :) lol. That is the 720 i regret selling still to this day, but this 720 NO lol. Ill try the sheriffs office. There needs to be bigger fines for this crap. If they hit and run someone whos at fault...me.

i had the same thing happen to me with a 77 celica. the idiot didn't transfer title for 6 months, (and I stupidly didn't file a report of sale)then it got stolen from him and abandoned on the highway and i had to pay to get it out of impound to avoid any more fines. then i filed for lost title and kept the car.:lol:

This doesn't work either...If the new owner doesn't transfer the title you are still liable. Don't know why, but I do know I've been stung a couple times after turning those in. Best bet is to go to the DMV with the person and transfer it there.

 

Funny story...My buddy Nuff got his truck stolen. He was notified by the police dept that his vehicle was found and that he need to pick it up or it would be towed. A year or 2 later a cop happens to run his plate (cause it's a beat up 4x4) and it was still listed as stolen even though the cops found it and told him to pick it up... :rolleyes:

Whatever you do, DON'T pay the ticket. Those collections people just want their money, so they'll tell you it's your fault. Bottom line is you sent in the release of liability, you should be covered. I would suggest talking to your local police department (go down there in person) and give them vin number, old plate number, and description of the truck and see what can be done about it. It might be a little bit of a hassle, but you should be able to get results that way.

Same here in washington, plates stay with the car. But you can still keep them. The new owner will have no problem getting new plates.

 

If you sent in the release of liabilty you are suupposed to to OK under WA. Call the Dept. Of Licensing in Olympia and discuss it with them. Forget talking to the other depts or the local agencies.
