I read the proposed rules and I think the concerns of the California New Car Dealers Association are spot-on:

 

CARB is proposing to require every repair dealer to check the inflation of every tire during repair to improve mpg for all vehicles which, in theory, is meritorious.

 

However (the) regs. CARB’s pushing through (released this week and subject to a 15 day comment period) ... provides that the only times that consumers may decline a check and inflate service—they can never decline the service if it’s offered for free—is when they are charged for services AND if they can PROVE (with DOCUMENTATION!) that they’ve had their tires checked and inflated in the last 30 days, or if they WILL do so within the next week. It is unclear, but possible, that CARB could take enforcement action against the consumer if they don’t follow through with their promise?!

 

Note that even the Department of Consumer Affairs opposed the last draft of these rules—letter attached (and I’m guessing these amendments won’t remove their opposition). CARB’s not messing around with these either—the potential penalty for violating the regulation is at least up to $1,000 per violation and six months imprisonment. The enforcement section referred to by CARB states that a violation of the regulation shall be “deemed to result in an emission of air contaminants,” potentially leading to even harsher penalties.

 

Too much. CARB is interpeting AB 32 in such absurdly broad fashion it wants to deputize the state's auto boards to bully all vehicle owners. It's too much for Brian Stiver, director of the state Department of Consumer Affairs, and Sherry Mehl, chief of the state Bureau of Auto Repairs:

 

Unless (Automotive Service Providers) offer the (tire check/inflation) service for free to the consumer and the consumer accepts it, the regulation would have the effect of either forcing the ASPs to check tires without the consent of the consumer in violation of the ... Automotive Repair Act, or force ASPs to refuse to provide any repair services at all to the consumer. These are legally untenable options ...

 

When does the backlash begin? These people are insane.

 

Note the "documentation" requirement for vehicle owners who say their tires are properly inflated. These owners can't be trusted to do this complex procedure all by themselves and then tell the truth about it. No, they have to GET OUTSIDE PROOF!

 

I will ask the gov's office if it backs the nuts at the air board or the sane people from the state Department of Consumer Affairs.

When you realize that the primary function of any government agency is to perpetuate itself, you can then see how this happens.

 

On the surface, this is not really that bad of an idea. People simply do not maintain their cars like they should, myself included. And I care about cars, they are an interest to me.

 

I do not want to generalize, but there is a possibility that a fair number of persons of the female gender are more interested in what the latest exploits of a bunch of attention whores from New Jersey are doing, than they are in the air pressure in their tires.

 

But to be honest, complaining about it here is preaching to the choir.

I think I will now got outside, and check my tire air pressure.

Most of the ASP's (that makes me lol for some reason) don't even know how to determine the correct air pressure in the first place. Every tire place I've been to just fills them to the max psi listed on the sidewall. They never take into account that that max pressure is for the maximum load. Most cars are nowhere near that, over inflation is usually the result.

 

Of course the flip side is those people that never even look at their tires...do they think that tires are air tight or not subject to atmospheric conditions?

 

Way to try and regulate stupidity CA...good luck with that :lol:

But ya Women as a whole are oblivious. I got hit again the other day... parked lol. It's like the 3rd time it happens in 2 years while I'm sitting in the truck waiting for someone.

 

Isn't Cali always trying to pass ridiculous stuff? I remember not too long ago they wanted to pass a bill saying you had to have a permit to grow your own food? lol

Honestly, I think they should implement a bi-annual safety inspection like some other states have. Check windows, tires, headlights, copious amounts of fluids coming out of them, stupid spinner rims and other retarded ideas!

 

Too many pieces of shit on the road with folks behind the wheel that do not care one damn bit and because of them, we suffer.

 

At least a headlight inspection! I am tired of being blinded by assholes that just instal headlights and do not adjust them!!

Man my state is hillbilly as fuck then, lol. Not only no emissions but we voted to remove our state inspections on cars. I've seen cars with flashlights duct taped in place of headlights.

 

 

GA was the same, at least in the 90s when I was there. I drove a piece of crap, but man, some of the shit on the road terrified me!

Mike has a great point. Trust me. Here in MA I don't need an emissions passed like at least '90 now. That is great! BUT I do have annual safety. I've bitched before on here about it, but to sum up.

 

-Failed for a Rusty Tailgate on a nearly 40 yr old Datsun "Someone could cut themselves!"

-Failed for the Windshield washer not functioning. Washer, not wiper. "If it came with it it has to work!"

-Failed for a cracked shifter boot. "No holes in the cab of any sort allowed" I am like "What about windows?!"

-Failed for 3 pencil eraser sized rust holes in Rocker. (Exhaust might get in.) I am like, "They are freakin boxed rockers!!!"

-Failed for a dealer frame around license plate. Can't even cover even a fraction of ANY writing on the plate.

 

Yeah dude it can get out of hand. I fear for the '59 which didn't even come with a sideview mirror. (Never had one.) Really old stuff gets grandfathered, for instance, pre-47 cars don't have to have fenders (but that may be changing.) But we shall see.

Am I wrong or CA is in $$ trouble politically speaking? I think this measures are sooo stupid.....who cares about the amount of money you guys spend in gas? Thats only a law for collecting funds and mess with the citizens that pay their taxes. i think its a global symptom, because here in Guate, the president wants to put extra taxes to de cellphone minute and each SMS, claiming that a cellphone is a luxury item, and he doesnt even count that way inside a mountain there is a poor old guy usign a cellphone. Here in Guate there is a statistic of 2 cellphones per capita.

 

its all about the political scum that are all around the world, they just cant touch their monthly payment to balance the state income.

One must also remember that quite a few of these laws come into being due to someone suing the crap out of someone else!

 

Mechanics know very well that as soon as they touch a car, they are responsible for everything else that happens to the car!! How many times have you heard someone say "it was fine until I took it to them to fix"! Someone gets a flat tire, it should have been the garages job to check them for me, right? They fixed the radiator and now that is why my Radio does not work anymore!

 

 

Trust me, we need a law to ban stupid people!

A very true statement. When I worked for Mercedes I would get shit for insisting that the service advisor make the customer sign my repair story when they refused repairs on safety items, or critical systems. Quite a few times when the customer would actually read what i wroote, they would opt to have the car repaired.

 

You see some crazy shit as a tech. A noisy brake complaint came in to the shop once, the wheel bearing had given out, and the spindle sheared... The wheel was being held on by the caliper! and the caliper had a broken bolt! AND THEY DROVE IT INTO THE SHOP!

 

And then customers that ask for a diagnosis, deny repair, and say that they were just looking for a second opinion after a 2 hour diagnosis on a convertible top.

 

So,yes, many drivers are very very stupid. And I do agree that service techs should check tire pressure, and should know that you simply need to look for the manufacturers recommended inflation pressure for the vehicle... But to make it a law, stop it. We do not constantly need new laws, and regulations, and we certainly don't need to pay groups of people just to invent them.

 

And then there is workers comp, and the total destruction of that system... but that is a whole other story.

Most government agencies are given an annual budget. If it is nearing the end of the fiscal year, and the agency is below budget, the employees are instructed to spend the money, because if they do not spend it all, their budget will get cut the next year.

 

And then you get politicians defining a budget cut as not getting a budget increase they hoped for, and add in labor unions helping to get liberal politicians in office, and then liberal politicians passing legislation that helps labor unions, you end up with the mess California, and our nation are in now.

 

Taxing the rich to help the poor seems like a good idea, until there are no rich anymore.

Socialism works really great until you run out of other peoples money.
