datsunaholic Posted July 13, 2010 Report Share Posted July 13, 2010 It's true, they only have to pay cash value or the cost of repairs, whichever is less. Then pay them BACK the salvage price if you keep it... and metal prices are up, it's around $200 a car. However, the valuation is not concrete. They are intentionally undervaluing it. The problem is that they generally with cars that old use the State's reported sales figures and average-low the price. That's where you get hurt by folks who underreport sale price for tax purposes- sure, they only pay taxes for $100, but the State then values them down based on average. Then the insurance company screws you. You're in an even worse position because they know that you don't have any injuries to report, since it was parked. But you're going to have to fight them tooth and nail. Quote Link to comment

When she gets pissed off that she is being sued she will be screaming at the insurance company. Either they will pay or once i win they will have to pay because they insure her. Quote Link to comment
datsunaholic Posted July 13, 2010 Report Share Posted July 13, 2010 Considering she has already been charged with leaving the scene of an accident, that may be the way to go. You will have to prove the insurance company isn't dealing fairly in that case, but it's probably easier to convince a judge than the adjuster. But you'd better have receipts for what you paid for it plus improvements, or it's just going to be valued at what the State says it's worth. Have to have your ducks in a row AND photographic evidence if you bought low and did improvements. Of course, those same ducks can be used against the insurance adjuster... especially if they get word of a suit. Quote Link to comment
