Hope for America (as opposed to "destruction of")

It isn't much, and the media will (more likely, already has) flood discontent.   The 24hr  liberal/socialist/communist machine  will now misinterpret, mock and challenge via manipulated “facts”and  bold faced lies. The presiding Judge, Robert T. Benitez, will  be smeared, or worse.

 

Benitez, is a District Court judge, who just put a legal smack down on California's bull shit gun control laws. He wrote a detailed decision, blasting the Attorney General and supporting the Second Amendment. I will try to attach the decision to this post. I am certain that 9th Circuit will overrule on appeal, but the heavily fact based decision, will make for a difficult overturn. Benitez knew not to bring a knife to the upcoming legal gunfight. It will be overturned, but it will require side stepping  the Constitution on an unprecedented scale. Hopefully, when this case reaches the Supreme Court, there will people who care about the Constitution.

 

Unfortunately, this is a small temporary win, in a dirty war. Going through the appeals process is a long and tedious journey, reaching SCOTUS, doubly so.  I might be dead or America devolved into a fascist/communist territory and I just wish I was dead. I lack faith in the resolve of younger generations. But, if you are here, then you might make it.

 

One of experts  supporting the gun control laws, Lucy Allen, has an impressive ivy league resume, but the sense of a box of rocks. If you read the decision it is comical. My theory, if you watch the liberal news, read the liberal magazines, work in “liberal” “progressive” environments, your brain softens. Without pushback, ideas become static and thinking is like playing handball against the drapes, (For those who do not read the decision, Allen complied her “objective” statistical analysis on media reported information,  without investigation or corroboration.)

 

I’ll take my wins, where I find them. There is at least one high level federal employee, in California, not wasting air.

Clear and unequival decisions are delayed indefinitely by air head politicians and so called do gooders.  Why should a well reasoned decision on basic constitutional rights escape such delays ?  Kudos to the gutsy judge.

I was happy to hear about it.Anything the left does that gets overturned or at least challenged is always a good thing.I do believe Grusome and his ilk will find a way legal or not to step around the decision.That POS will probably sign an executive order or something drastic like that.

Can't really tell much difference overall although trespassing and petty thefts from carports, garages, back yards, etc have dropped quite a bit. Road rage incidents have went down significantly too now that I think about it.

 

Lots of fucktards (rightly) getting busted for toting into the beer joint. Johnny Law slams 'em down like they'd punched his mama in the face and suggested he should engage in intercourse with himself and the equine that conveyed him to the locale.

 

Also noticed recently that bars are putting up signs reminding pot folks that """"medicinal"""" ganja (also recently legalized here) is a big no-no in the places where they sell that piss that made Milwaukee famous. Lots of weed enthusiasts were shocked to learn how many of the local liquor license holders are totally not cool, man. FYI, our governor broke with national trends and saw to it that possession of a weed card doesn't infringe on a person's 2nd Amendment rights. I'm in my fifth decade of life here and he's the only one running the show who didn't do something so cringey that it just made your asshole pucker up and suck buttermilk. The one before him actually bought a "manufactured home" (that's a trailer house for us old timers), put it on the state capitol grounds and let her daughter live there. That was a proud Sooner moment.

 

You see almost no signs in shop windows restricting firearms entirely but quite a few requesting that you conceal carry rather than open carry. I open carry in the yard or if I'm at the lake or the salvage but can't bring myself to strap a hog leg on my hip for all the honest world to see and stroll into the Rib Crib or the Walmart (lots do though) like Wild Bill striding into the Long Branch. Got no issues with those who choose to do so (proud for 'em honestly) but it just ain't my thing.

 

I miss my America of the 1980s where cops were the only folks toting openly and if they shot a son of a bitch he probably needed shooting. I know.......those days are as gone as going to the movies on a Saturday afternoon and getting your Moxie, Moon Pie, popcorn, Betty Boop and Tom Mix for a pure silver 25¢ piece. (I had a great uncle who kept his first 25¢ piece until the day he died - hell, he actually married the bitch).

While I side unquestionably with the right to bear arms, I find "open carry", useless unless hunting, or in the back country, and most often embraced by those who wish to "appear" powerful. To restate for clarity, I will go to the mat against ANY reduction of the Second Amendment and, if needed will, sign a petition, march in parade, write, call, or otherwise harass politicians, to vote for gun rights, including open carry. The weaselly, left, over the years, has exploited law, intentionally manipulated statutes,even bold faced lied, to strip gun rights. ("Common Sense" gun regulation is most certainly NOT) As a result, I refuse to consider, whatever game they're playing. My policy makes the ballot box a stress less event. Politicians, at any level of government, are segregated based on their answer to a single question: Support the NRA and the Second Amendment, you have my vote and support: Failure to completely support the NRA, you lose my vote and support.

 

My theory, regarding most who open carry, in public spaces, is that it is a purposeful attention grab and display of "power", for the otherwise lacking. Confirmation of my theory, can be seen in the many video clips on YouTube, of armed individuals waving firearms, at each other, without firing. Contrary, to every criminal justice program on television, revealing you are armed, should be limited, to when you are legitimately in fear of loss of life. If confronted by a "tense" situation, avoid it. If carrying and insulted, walk away from it.

I'm no legal scholar, but have researched this area of law, and have been unsuccessful locating, any law that requires the victim of an attack to notify their attacker, that they are armed, prior to initiating self defense. Displaying you own a firearm is of no benefit and more probably than not, a serious determent.

 

Again, only those whose words and/or actions demonstrate immediate willingness and capability to do you serious harm, thereby placing you in fear for your life and/or the lives of others should discover you conceal carry, as a final thought. And to repeat the information one more time to remove any confusion, use of deadly force with a firearm is only authorized i.e. will not incur the penalties, prescribed,by criminal law, for harming another. if there is evidence sufficient to demonstrate the words or actions of the assailant, put you in immediate fear for your life or the lives of others.

Ha ha, I was merely picking on the image, not the rights. We can own guns. Not open carry. 

 

To be honest though, up until maybe the last 12months I have never had or felt I needed a reason to have one. Funny thing is my wife actually said to me she thinks we should get one due to all the current bullshit. 

 

I've never sat down and looked at it but if you corrected for population numbers our murder rate is probably similar? Like in the US the most violent portion of our population is also most likely to own one illegally anyway. 

 

I want a gun to protect me from the government, not everyday criminals.

The open carry movement around Spokane Wa was big about 10 years ago. I was involved in writing the Spokane PD training bulletin on OC. The Spokane Co sheriff also wrote a bulletin on OC emphasizing it is not illegal.

I work downtown and CC during the winter but it is hard to CC during the summer so I OC. I see transients walking around with pipes and baseball bats on a daily basis, I just keep my distance.

It is not a "power trip" nor am I an "attention whore". The more people that OC the more it will become common place.

On a side note, I was just in Colorado and saw a guy OC at a Walmart (it is legal to OC in Colorado), from what I could tell no ran screaming from the building.

 

For me, protection from the gov is a whole different story, too long to get into here.

I'm in Denver area, never really cared to own, but like it's been said, with today's bullshit going on, I am considering it.  Got plenty of buddies that CC & OC to guide me, including a cop or two!

Absolutely. Not all Miata drivers are gay nor all dual wheel diesel 350 Super Duty Ford owners over compensating for a deficiency.

 

On the flip side the less people OC the more common it becomes.

No mention that we have worked with the police to  keep them informed of the laws.
